SASA Posted September 3 Share Posted September 3 SAN ANDREAS CRIMINAL CODE SENTENCING ENHANCEMENTS TITLE IX - SENTENCING ENHANCEMENTS 901. Use of a Firearm in the Commission of a Felony Any person who uses a firearm during the commission of a felony shall receive an enhanced sentence. Penalty: Additional 3 to 5 days of imprisonment added to the original sentence. 902. Prior Convictions Any person with a prior conviction of the same or similar offense within the last 5 years shall receive an enhanced sentence. Penalty: Additional 2 to 4 days of imprisonment added to the original sentence. 903. Gang Affiliation Any person who commits a crime as a part of or in association with a gang, or with the intent to promote, further, or assist criminal conduct by gang members, shall receive an enhanced sentence. Penalty: Additional 3 to 6 days of imprisonment added to the original sentence. 904. Hate Crime Enhancement Any person who commits a crime motivated by bias against a person’s race, religion, ethnicity, nationality, gender, sexual orientation, or disability shall receive an enhanced sentence. Penalty: Additional 4 to 6 days of imprisonment added to the original sentence. 905. Repeat Offender Enhancement Any person who is convicted of the same felony offense three or more times within a 10-year period shall receive an enhanced sentence. Penalty: The original sentence shall be doubled. 906. Organized Crime Enhancement Any person who commits a crime as a part of an organized crime syndicate or in furtherance of the goals of such a syndicate shall receive an enhanced sentence. Penalty: Additional 5 to 10 days of imprisonment added to the original sentence. 907. Use of Explosives Any person who uses explosives in the commission of a crime shall receive an enhanced sentence. Penalty: Additional 4 to 8 days of imprisonment added to the original sentence. 908. High-Value Theft Any person who commits theft of property or money valued over $100,000 shall receive an enhanced sentence. Penalty: Additional 3 to 5 days of imprisonment added to the original sentence. 909. Injury to a Peace Officer or Public Official Any person who causes injury to a peace officer or public official during the commission of a crime shall receive an enhanced sentence.
