VEHICULAR OFFENSES


TITLE IV - VEHICULAR OFFENSES

401. Driving Without a Valid License (M)
Any person(s) operating a motor vehicle under an expired license, or operating a motor vehicle without a license in any capacity. This extends to persons under the age of 16 operating any motor vehicle.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 30 minutes to 1 day of imprisonment, a fine of $2,500, and a 1-day vehicle impound.

Note: Airport vehicle leases are exempt from license requirements and operate under temporary permit status as per agency issue. Any dealership vehicle leases are not exempted from this offense.


402. Driving on a Suspended License (M)
Any person(s) operating a motor vehicle at any time when that person's driving privilege is suspended or revoked.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 45 minutes to 1 day of imprisonment, a fine of $5,000, and a 2-day vehicle impound.

403. Hit and Run (M/F)

a) Any person who, while operating a motor vehicle, is involved in an accident resulting only in damage to property or other vehicles, and fails to immediately stop the vehicle at the scene of the accident.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 6 hours to 1 day of imprisonment.

b) Any person who, while operating a motor vehicle, is involved in an accident resulting in injury to a person, other than themselves, or in the death of a person, and fails to immediately stop the vehicle at the scene of the accident.

  • Penalty: Classified as a Class A felony (4) or Class B felony (3). Punishable by 12 hours to 3 days of imprisonment.

404. Reckless Operation of an Off-Road or Naval Vehicle (M)
Any person engaging in reckless or careless usage of a non-aerial or street-legal vehicle with or without intent but with the creation of distress or the opportunity to cause harm. This can include ATVs, golf carts, boats & naval vehicles, or other equipment not driven on roads.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 1 hour to 1 day of imprisonment, and a fine under the following criteria of offense count:

    1. $2,500 fine
    2. $5,000 fine
    3. $15,000 fine + 7-day impounding of vehicle + 3-day suspension of license

Note: If the offense is continued, punishment shall revert back to the third offense and continue to be issued. Sentencing enhancements are allowed for this charge.


405. Speeding (I)
Any person, at all times, on any official state, county, or local roads, must maintain a maximum speed of 100 MPH on highways, 75 MPH on county roads outside city limits, 60 MPH on roads within city limits, 45 MPH on roads in areas designated as a "State Park" or "Hunting Zone," and 45 MPH on roads in school and university zones. Drivers must use fair judgment when driving on roads with adjusted conditions (such as closed, unpaved, slick, and damaged roads).

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $2,500 fine
    2. $5,000 fine
    3. $7,500 fine + 2-day impounding of vehicle + 3-day suspension of license

406. Failure to Yield/Stop to a Traffic Control Device (I)
A vehicle that fails to follow traffic control devices, such as:

  • Not yielding to an emergency vehicle with visible emergency lights and sounding sirens;

  • Crossing a double yellow line when NOT entering or leaving a parking lot or driveway;

  • Ignoring signs, roadblocks, hand signals, or other equipment used by law enforcement to direct traffic;

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $1,000 fine
    2. $2,500 fine
    3. $5,000 fine + 3-day suspension of license

407. Illegal Parking (I)
Any vehicle parked unlawfully according to the Parking Definitions Act of 2021. These include, but are not limited to:

  • Obstructing a lane of traffic and preventing traffic from properly flowing.
  • Obstructing a driveway, private road, path, or alleyway, preventing traffic from entering/exiting.
  • Obstructing a parking lot, preventing vehicles from leaving or entering.
  • Parking within a marked crosswalk.
  • Parking on any sidewalk or median.
  • Parking facing opposing traffic.
  • Parking against a red curb, except where permitted by the Parking Definitions Act.
  • Parking on any bridge, tunnel, or freeway shoulder lane except for emergencies.
  • Parking near railroad tracks, posing a risk of the vehicle being struck by railroad cars.
  • Parking directly in front of or within five feet of a fire hydrant.
  • Parking at a helipad or aircraft landing zone if controlling a non-aerial vehicle.
  • Taking up two parking spaces.
  • Parking more than two motorcycles abreast in one parking space if the parking is wide enough.
  • Parking in a handicap space without a handicap identification permit.
  • Parking a non-electric vehicle in a space with an electric charger.

Note:

  • Private property owners have the right to determine parking rules for their property, provided it does not violate the Parking Definitions Act of 2021.

  • Vehicles obstructing traffic or posing a public risk may be impounded for 1 day.

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $1,000 fine
    2. $2,500 fine
    3. $5,000 fine

408. Reckless Driving (M)
Any person who does not use care or caution while operating their vehicle with blatant disregard for the safety of others, or drives in a grossly negligent manner so as to endanger the life, limb, or property of any person.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 1 hour to 1 day of imprisonment, and a fine under the following criteria of offense count:

    1. $2,500 fine
    2. $5,000 fine
    3. $10,000 fine + 4-day impounding of vehicle + 7-day suspension of license

409. Vehicular Noise Violation (I)
Any person operating a vehicle that emits excessive noise through unnecessary horn usage or loud music without regard to noise pollution.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $1,000.

410. Negligent Operation of a Vehicle (I)
Any person operating a vehicle in a manner that could lead to personal injury or damages to another vehicle or individual. Examples include texting while driving, failure to maintain lanes, driving without lights between sunset and sunrise.

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $2,500 fine
    2. $5,000 fine
    3. $7,500 fine + 2-day vehicle impound + 3-day suspension of license

411. Illegal Usage of Hydraulics (I)
Any person operating a vehicle with hydraulic equipment installed on the chassis or other components without legitimate need or purpose (e.g., a forklift) may not use such hydraulics on state, county, or local roads.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $2,500.

412. Tinted Windows (I)
Any person operating a vehicle with unlawfully tinted or anonymizing shades on the windows, leading to the inability to identify the driver while driving, unless exempted under standing laws.

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $1,000 fine
    2. $2,500 fine
    3. $5,000 fine + 1-day vehicle impound
      ((Note: Tints of Level 1 and 2 are considered illegal unless stated otherwise by exemption laws.))

413. Driving under the Influence of Alcohol or Narcotics (DUI) (M)
Any person who drives or operates a vehicle or machinery while under the influence of alcohol above the legal limit of 0.08% BAV or under the influence of performance-altering narcotics, regardless of whether those drugs are legal or illegal.

  • Penalty: Classified as a Class C misdemeanor. Punishable under the following criteria:

    1. 3 hours imprisonment + 3-day license suspension + 3-day vehicle impound
    2. 6 hours imprisonment + 7-day license suspension + 7-day vehicle impound + $7,500 fine
    3. 1-day imprisonment (upgraded to Felony [2]) + 7-day license suspension + 7-day vehicle impound + $12,000 fine

414. Motor Vehicle Contest (M/F)

a) Any person performing an unlicensed or undesignated race or competition on city, county, or state paved roads or courses that incites the potential for other violations or demonstrates a potential for hazard.

b) Any person who willfully flees or otherwise attempts to elude a pursuing peace officer following a violation of provision (a) of this offense.

  • Penalty: Classified as a Class C misdemeanor for provision (a). Punishable by 1 hour to 1 day of imprisonment, a 7-day license suspension, a fine of $5,500, and a 7-day vehicle impound.
  • Classified as a Class C felony (5) for provision (b). Punishable by 1 to 3 days of imprisonment, a 7-day license suspension, a fine of $15,000, and a 10-day vehicle impound.
    Any violation of 115. Evading a Peace Officer is to be charged additionally.

415. Vehicular Endangerment (F)
Any person driving or operating a vehicle and causing severe endangerment, actual physical harm, or risk of physical harm to pedestrians, and/or driving in a manner that places the public in grave danger.

  • Penalty: Classified as a Class A felony (4), Class B felony (3), or Class C felony (2). Punishable by 1 to 5 days of imprisonment, and a fine of $10,000.

416. Jaywalking (I)
Any person who intentionally or recklessly crosses a road as a pedestrian in a manner that creates a foreseeable risk of obstructing the flow of traffic or otherwise creates a hazard to road users.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $1,500.

417. Possession of Open Container (I)
Any person who holds possession of open containers of alcoholic beverages or any containers carrying performance-altering substances while operating a vehicle.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $1,000.

418. Failure to Wear a Seatbelt/Safety Equipment (I)
Any person who, while operating a motor vehicle, does not properly secure themselves with a safety belt or adhere to traffic safety standards when operating vehicles such as motorcycles, ATVs, and other wheeled single-track vehicles without a helmet or other proper safety equipment.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $1,000.

419. Operation of Unsafe Motor Vehicle (I)
Any person who drives or moves a motor vehicle, cycle, or combination of vehicles on any public road in an unsafe condition that endangers any person or property, suffers substantial structural damage, or is not equipped with lights, brakes, steering, and other equipment in proper condition.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $2,000 and a 2-day vehicle impound.

420. Vehicle Registration Violation (I)
Any person who drives, moves, or leaves standing upon a public road any unregistered motor vehicle or any motor vehicle that does not display an identification plate, or who, within the time required by law, fails to pay their vehicular insurance bills.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $5,000, a 3-day vehicle impound, and a 3-day license suspension.

421. Operating an Aircraft Without A License (M)
Any person(s) who operates any aircraft without the appropriate license.

  • Penalty: Classified as a Class C misdemeanor. Punishable by 2 to 5 days of imprisonment.

422. Reckless Operation of an Aircraft (F)
Any person(s) who endangers life through the operation of their aircraft, such as flying at low altitude in an urban or suburban area.

  • Penalty: Classified as a Class C felony (3). Punishable by 2 to 6 days of imprisonment, a revocation of the pilot's license, a fine of $50,000, and a 3-day vehicle impound.

423. Failure to Adhere to ATC (F)
Any person(s) who, while operating an aircraft, fails to adhere to ATC protocol or commands.

  • Penalty: Classified as a Class C felony (2). Punishable by 1 hour to 1 day of imprisonment, and a fine of $50,000.
    ((Note: This charge is currently suspended. DO NOT charge this on any person.))

424. Aerial Evasion (F)
Any person(s) who evades any law enforcement agency via an aircraft, whether as a pilot or passenger.

  • Penalty: Classified as a Class C felony (4). Punishable by 2 to 4 days of imprisonment, a fine of $100,000, and a 7-day vehicle impound.

425. Negligent Operation of Bicycle (I)
Any person(s) operating a bicycle in a manner that will likely cause property damage or harm to other road users or pedestrians.

  • Penalty: Classified as a Class C infraction. Punishable by a fine of $2,500.

426. Operation of an Unauthorized Vehicle on Vespucci Beach (I)
Any person(s) engaging in the unlawful operation or usage of a vehicle directly in violation of the Vespucci Beach Motor Vehicle Regulations Act.

  • Penalty: Classified as a Class C infraction. Punishable by the following criteria:

    1. $2,500 fine
    2. $5,000 fine
    3. $7,500 fine + 3-day impounding of vehicle + 3-day suspension of license

427. Street Takeover (F)
Any person who aids in the process of, or actively takes part in taking over a portion of a public highway, public roadway, public parking lot, or private parking lot without explicit consent provided by the property owner by blocking or impeding the regular flow of traffic to perform a race, drag race, burnout, doughnut, drifting, wheelie, other stunt driving, or other form of recklessly operating a motor vehicle or motorcycle.

  • Penalty: Classified as a Class C felony (5). Punishable by 1 to 3 days of imprisonment, a 7-day license suspension, a fine of $20,000, and a 7-day vehicle impound.
    Note: If the offender willfully flees or otherwise attempts to elude a pursuing peace officer using a motor vehicle or motorcycle, the vehicle may be subject to 14 days vehicle impound. Any violation of 115. Evading a Peace Officer is to be charged additionally.

428. Excessive Speeding (I)
Any person, at all times, on any official state, county, or local roads of any scale, violates the maximum speed outlined by 405. Speeding, in excess of 30 MPH or more.

  • Penalty: Classified as a Class C infraction. Punishable by a fine under the following criteria:

    1. $8,000 fine
    2. $8,000 fine + 2-day suspension of license
    3. $12,000 fine + 3-day impounding of vehicle + 4-day suspension of license
    4. $15,000 fine + 7-day impounding of vehicle + 7-day suspension of license
    5. $20,000 fine + 10-day impounding of vehicle + 10-day suspension of license
